Terms of Service

These terms apply to the service of creating, hosting and operating an SMM panel offered by FollowerHQ ("we") at https://followerhq.com. By creating an account or using the service you accept them.

1. The service

We set up and host an SMM panel that runs on your own domain. The software, its updates, the infrastructure and the technical operation are ours; the services sold on the panel, the prices, the suppliers and the customer relationship are yours. Your plan's limits, renewal date and price are shown in your portal account.

2. Your account

  • You are responsible for the security of your portal account and for everything done through it.
  • You may create additional admin (staff) accounts for your panel; what they do is attributed to your account.
  • Your account details must be accurate and current: billing and important notices are sent to them.

3. Plan, price and renewal

  • The service is a subscription, invoiced in advance at the start of each period.
  • The renewal price follows the plan in force on the renewal date. The plan can change with your panel's volume; the current one is shown in your portal account.
  • If a renewal is not paid the panel is frozen: the site closes to visitors, no data is deleted, and the panel resumes where it left off once payment is made.
  • A frozen panel may be terminated after the notified grace period; on termination the data provisions of clause 10 apply.
  • Prices may change. A change never affects the period already running and is announced in advance.

4. Add-ons

You may attach optional add-ons to your panel (hosted e-mail, brand independence, the AI add-on, child-panel reselling, for example). Each carries its own price, appears on the same invoice and can be cancelled on its own. For the AI add-on you supply the model provider's key, and your relationship with that provider is yours to manage.

5. Your obligations as the panel owner

The panel is your business. Accordingly:

  • Towards your panel's customers you are the seller: ordering, delivery, refunds and support sit between you and them.
  • Your panel's own legal documents (terms, privacy policy and whatever else the law applying to you requires) are your responsibility. We ship ready templates for them; the templates are not legal advice.
  • You contract with the payment institutions (card acquirer, crypto gateway and so on) and you comply with their rules. Payments settle directly to your account; we are not a party.
  • Tax, invoicing and accounting obligations are yours.

6. Acceptable use

You may not use your panel or our infrastructure for:

  • Unlawful content, copyright infringement or infringement of anyone else's rights.
  • Fraud, money laundering, or the use of stolen cards or accounts.
  • Spam, distributing malware, attacking the infrastructure, or consuming resources abusively.
  • Selling on the strength of misleading claims.

Where this is breached we may suspend the panel without prior notice and, for serious or repeated breaches, terminate the account. Where the law requires us to notify anyone, we do.

7. Data and roles

For the personal data of your panel's customers you are the controller; we are a processor, handling that data only to provide the service to you and on your instructions. For your portal account and billing data we are the controller. The sub-processors we use are listed in our privacy policy.

Our engineers may access your panel data when you ask for support, or where a security or abuse investigation requires it; such access is logged.

8. Availability, maintenance and backups

We make reasonable efforts to keep the service running, but it is provided "as is" and no particular uptime is guaranteed. Planned maintenance is scheduled for low-traffic hours where possible. We take regular backups; they exist for our own recovery purposes and are not a substitute for exporting your own data.

9. Domain and certificates

The panel needs your domain pointed at us to work. Ownership of the domain and its registration fees are yours. SSL certificates are obtained and renewed automatically; panels are served over HTTPS only.

10. Termination and data

You may close your account at any time; closure takes effect at the end of the period in force and, unless stated otherwise, a period paid in advance is not refunded. On termination you are given a reasonable window to retrieve your data, after which the panel data is permanently deleted. Billing records we are required to keep are retained for the statutory period.

11. Limitation of liability

Our liability for direct loss is limited to what you paid us in the twelve months before the event causing it. We are not liable for indirect loss such as lost profit, lost data or business interruption. Loss caused by third-party services (payment institutions, suppliers, social media platforms, domain registrars) changing their rules, going down or making a decision falls in that category. These limits do not apply where the law does not permit them.

12. Changes

We may update these terms. Material changes are notified to the e-mail address on your account or through the portal before they take effect. The current version is always published on this page.

13. Governing law

This agreement is governed by the law of England and Wales, and the courts of England and Wales have jurisdiction over disputes. Rights the law of your own country of residence gives you as a consumer, and which cannot be removed by contract, are unaffected.
